GENERAL TERMS AND CONDITIONS

These General Terms and Conditions determine the conditions of use of “Joane K _” website (hereinafter referred to as the "Website") which the end Purchaser (hereinafter referred to as the "Purchaser" and/or "You") expressly and/or tacitly accepts when consulting this Website. "We", "Us" or "Our" in this Agreement) refers to “Joane K _”, Lebanon

If the User does not accept these Terms and Conditions, then she/he will not be able to access the Website. These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content.
If the User is a minor under age, it is the obligation and the responsibility of their parents who have previously accepted these Terms and Conditions to be present when using the Website.

These General Terms and Conditions may be modified at any time at the sole discretion of “Joane K _” or any of its affiliates, subsidiaries, representative offices, or sister companies (altogether hereinafter referred to as “Joane K _”) without any prior notification. All the amended Terms and Conditions shall be immediately effective when posted on the Website. Therefore, they rule and govern any and all subsequent use of the Website, the previous uses being ruled by the Terms and Conditions which were valid and applicable at the date of such use. Any new features or tools which are added to the current store shall also be subject to the Terms of Service.

These General Terms and Conditions are governed by and interpreted in accordance with the Lebanese laws, especially the law number 81 dated October 18th, 2018 related to electronic transactions and personal data, and the law number 75 dated April 3rd, 1999 related to the protection of literary and artistic property.
You may not use our products for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).

By consulting the Website, the Purchaser agrees to respect the Terms and Conditions of use, as displayed at the date on which the Website is visited. 

1.    GENERAL PROVISIONS

a.    The Joane K _BRAND is authorized to sell statement accessories.
This authorization allows the brand to facilitate the sale and transfer of ownership of the statement accessories to the Purchaser, ensuring all necessary agreements are upheld in accordance with the established terms and conditions.

b.    By accepting these Terms and Conditions, you acknowledge that you agree to and must comply with all the conditions outlined in these Terms and Conditions, and in the agreement between you and “Joane K _” brand, as well as those specified on the sale invoice (altogether hereinafter referred to as the "Terms").

c.    In the event of any contradiction between the clauses outlined in the agreement between the Purchaser and the “Joane K _” brand and any other clauses mentioned in the Terms and Conditions; the provisions of the agreement will prevail over any other Terms.

d.    You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service or any contact on the website through which the service is provided, without express written permission by us.

e.    We are not responsible if information made available on this site is not accurate, complete or current. The material on this site is provided for general information only and should not be relied upon or used as the sole basis for making decisions without consulting primary, more accurate, more complete or more timely sources of information.

f.    We reserve the right to discontinue any product at any time. Any offer for any product or service made on this site is void where prohibited.
We do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected.

2.    PRICE

a.    Prices are valid as long as they remain published on the Website. The “Joane K _” brand reserves the right to adjust the prices at any time without prior notice, but any such changes will not affect orders already confirmed.

b.    All prices are quoted in Dollar ($). The Purchaser is responsible for any currency conversion fees that may apply based on their payment method or location.

c.    The prices listed on the Website included VAT in Lebanon.

3.    PAYEMENT POLICY 

a.    We accept the following forms of payment:
        Credit/Debit card: VISA/MASTERCARD
        Cash on delivery (“COD”) only in Lebanon.

b.    All credit/debit card payments are subject to validation checks and authorization by the issuer. If the issuer of the credit/debit card refuses to authorize payment, we will not be liable for any delay or non-delivery. We will cancel your order and contact you for an alternative method of payment.

c.    The details on the credit/debit card used to make the payment must match the exact ID information of the cardholder as held by the issuer. Payment will be debited and cleared from your account upon the dispatch of your order by “Joane K _”. You confirm that the credit/debit card that is being used is yours or that you have been specifically authorized by the owner of the credit/debit card to use it.

d.    No credit/debit cards’ details will be stored, sold, shared, rented or leased to any third parties except by our online payment gateway service provider.

e.    We take reasonable care to make the Website secure. Rest assured that your card number will be protected using SSL (Secure Socket Layer). SSL is a security technology that encrypts your card details and provides a secure connection between Internet browsers and websites, allowing you to transmit private data online. We take reasonable care, in so far as it is in our power to do so, to keep the details of your order and payment secure, but in the absence of negligence on our part we cannot be held liable for any loss you may suffer if a third party procures unauthorized access to any data you provide when accessing or ordering from the Website.

f.    If the Purchaser is unable to make payment using the specified methods, they must contact us to arrange an alternative payment method within 72 hours. If no alternative payment arrangement is made within this period, the order will be canceled. 

g.    The total cost, will be clearly displayed before the order is finalized.

4.    PICK UP AND DELIVERY AND SHIPPING TERMS

a.    We deliver to Lebanon, pickup or delivery must occur within seven days of placing the order.

b.    Worldwide delivery or pickup time is determined on a country-by-country basis, typically starting from 10 days.

c.    We will deliver your order to the address specified in your order.

d.    Delivery charges will be indicated during your check out process, in your local currency.

e.    We will process your orders excluding Week-ends and public holidays.
If no one is available to accept delivery of the order, you will have the option to arrange for an alternative delivery date or be given additional information about the collection of your order from the courier company.

          The responsibility for picking up the statement accessories rests with the Purchaser. However, if the latter opts for delivery, they will assume full responsibility for all associated costs, risks during transit, and liabilities, including transportation fees. In this case, the “Joane K _” brand will not be held liable for any damage or loss that may occur during transit.

          If this condition is not met, the statement accessories will be considered as delivered, and all associated risks will transfer to the Purchaser, the Purchaser assumes full responsibility for the statement accessories.

         
5.    CANCELLATION AND EXCHANGE POLICY

“Joane K _” brand's top priority is to satisfy all its customers.

Please note that you may exchange your order within 24 hours from the date of delivery in case of any damage or error, provided that the packaging is intact.

In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.

NO Refunds

6.    ERRORS, INACCURACIES AND OMISSIONS

Occasionally there may be information on our site or in the Service that contains typographical errors, inaccuracies or omissions that may relate to product descriptions, pricing, promotions, offers, product shipping charges, transit times and availability. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information in the Service or on any related website is inaccurate at any time without prior notice (including after you have submitted your order).

We undertake no obligation to update, amend or clarify information in the Service or on any related website, including without limitation, pricing information, except as required by law. No specified update or refresh date applied in the Service or on any related website, should be taken to indicate that all information in the Service or on any related website has been modified or updated.

7.    DATA PRIVACY AND SHARING

By using the Website, you consent to the “Joane K _” brand collecting and processing your personal information to fulfill its obligations to you and for administrative purposes. The “Joane K _” brand may share this information with its affiliated companies and third parties as necessary to complete its obligations.

8.    TERMINATION

The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes. These Terms of Service are effective unless and until terminated by either you or us. You may terminate these Terms of Service at any time by notifying us that you no longer wish to use our Services, or when you cease using our site. If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof).

The “Joane K _” brand reserves the right to terminate any sale at its sole discretion if any of the terms and conditions of the sale are not met.

9.    ENTIRE AGREEMENT

The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision. These Terms of Service and any policies or operating rules posted by us on this site or in respect to The Service constitutes the entire agreement and understanding between you and us and govern your use of the Service, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms of Service).Any ambiguities in the interpretation of these Terms of Service shall not be construed against the drafting party.

We reserve the right, at our sole discretion, to update, change or replace any part of these Terms of Service by posting updates and changes to our website. It is your responsibility to check our website periodically for changes. Your continued use of or access to our website or the Service following the posting of any changes to these Terms of Service constitutes acceptance of those changes

11.    JURISDITCION AND GOVERNING LAW

The Terms shall be governed by the laws and regulations Lebanon. You irrevocably consent to the exclusive jurisdiction and venue of the courts in Lebanon - Beirut for all disputes arising out of or relating to these Terms.
